ACCIDENT WAIVER & RELEASE OF LIABILITY
Golfing indoors and through the use of a simulator is considered a low risk activity, but nonetheless we’re required to notify you of the following:
By entering Essex Indoor Golf Center, located at 23 Saybrook Road, Suite 5, Essex, CT YOU HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH ESSEX INDOOR GOLF CENTER LLC AND THE ENTIRE FACILTIY LOCATED AT 23 SAYBROOK ROAD, SUITE 5, ESSEX, CT.
Please know that we have successfully removed all nuisance geese and gophers from the facility, and most of the alligators from the water hazards, but you do assume any and all risks that arise from your use of Essex Indoor Golf Center including from the negligence or carelessness on the part of the persons or entities that own and control the Golf Center, or from other guests, and from dangerous or defective equipment.
Further you certify that you:
- Are physically fit to participate,
- Have no health-related reasons or problems that preclude your participation,
- Are not wearing three different types of plaid, and
- Have not been advised to not participate in physical activity by a qualified medical professional (or an unqualified one).
IMPORTANT LEGAL LANGUAGE. (It’s bold so you will read it)
In consideration of your participation or presence at the Essex Indoor Golf Center, You hereby waive, release, and discharge Essex Golf Center LLC and its members, owners, and or employees from any all liability associated with your presence at the Essex Indoor Golf Center. Further, You agree to indemnify and promise not to sue Essex Indoor Golf Center LLC and its members, owners and or its employees from any and all liabilities or claims made as a result of my participation or presence at the Essex Indoor Golf Center.
PHOTO RELEASE
Some of our employees really like to take pictures and videos for our social media pages and whatever Tik Tok is. I understand while participating in this activity, I may be photographed or recorded. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by Essex Indoor Golf Center LLC.
